Employment discrimination law, more specifically, where businesses instituting programs to avoid being sued don’t know what qualifies as discrimination and the just as uncertain judges look to said programs for their own cues.

But if it weren’t for Employment Discrimination Law and the various lawsuit-avoidance procedures it requires, then what would all those HR people do with their lives? Making sure there’s a suit-proof pro-forma custom-made for court exhibits paper trail for every hiring, firing, and promotion decision is 90% of the business value of those folks.
